En l&rsquo;esp\u00e8ce, si l&rsquo;entretien pr\u00e9alable avait \u00e9t\u00e9 men\u00e9 par l&#8217;employeur, la convocation \u00e0 l&rsquo;entretien et la lettre de licenciement avaient \u00e9t\u00e9 \u00e9tablies et sign\u00e9es par l&rsquo;expert-comptable.<\/p>\n<p>C\u2019est la r\u00e8gle que pr\u00e9cise la Cour de cassation dans une d\u00e9cision du 7 d\u00e9cembre 2011 (n\u00b0\u00a010-30222) en application des dispositions de l\u2019article L1232-6 du Code du travail :<\/p>\n<p><em>\u00ab\u00a0La finalit\u00e9 m\u00eame de l\u2019entretien pr\u00e9alable et les r\u00e8gles relatives \u00e0 la notification du licenciement <strong>interdisent \u00e0 l\u2019employeur de donner mandat \u00e0 une personne \u00e9trang\u00e8re \u00e0 l\u2019entreprise pour conduire la proc\u00e9dure de licenciement<\/strong> jusqu\u2019\u00e0 son terme.\u00a0\u00bb<\/em><\/p>\n<p>A d\u00e9faut, la proc\u00e9dure est sans cause r\u00e9elle et s\u00e9rieuse et justifie l&rsquo;octroi de dommages int\u00e9r\u00eats pour licenciement abusif.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La proc\u00e9dure de licenciement doit \u00eatre conduite par l&#8217;employeur jusqu&rsquo;\u00e0 son terme et ne peut \u00eatre d\u00e9l\u00e9gu\u00e9e \u00e0 l&rsquo;expert-comptable sous peine d&rsquo;\u00eatre qualifi\u00e9 de licenciement abusif ou sans cause r\u00e9elle et s\u00e9rieuse.
